It is a known fact that Dr. Mahtani and his lawyers have been submitting numerous evidences and documents to support their claims. Some of the major documents and evidences submitted during the trial period stretching over ten years include signed shareholder’s agreement, financial exhibits, investment reports which clearly indicate Dr. Rajan Mahtani’s investment into the factory which is worth more than USD 12 million. The evidences also comprised of testimonials from significant members of the factory as well as audit report from an independent auditor which clearly states that the Portland Cement Zambia factory was established as a joint venture and Dr. Mahtani was the sole joint venture partner. Even the latest judge overseeing this case made a positive announcement when it was finalised that the case hearing will be closed and both parties will be submitting their evidences or testimonials in written and oral format. Based on these evidences, the final judgment was to be announced.
However, when the final judgment came, it shocked everyone as it was given against Dr. Rajan Mahtani’s claims. It was clear that the judgment was misdirected and influenced. As a result, Dr. Mahtani has now made a fresh appeal to the higher court of appeal in Zambia. In his appeal he has requested the higher authorities to look into the matter and provide justice to this case
